These terms are an agreement between you and Avatar.gift about using the app. We have tried to keep them short and in plain language. By downloading or using Avatar.gift, you agree to them.

What Avatar.gift is

Avatar.gift is a personal AI that runs entirely on your iPhone. It remembers what you tell it, helps you get things done, and keeps your data on your device. Your conversations and memories belong to you — see our Privacy Policy for details.

Free trial and purchase

• The app is free to download and includes a 7-day full-featured trial, which starts the first time you actually chat with your AI.
• After the trial, continuing to chat requires a one-time purchase (not a subscription).
• If you don't purchase, your data is never taken from you: your memories, conversation history, and export features remain fully accessible.
• Purchases are processed by Apple through the App Store. Refunds are handled by Apple under their policies — you can request one at reportaproblem.apple.com.

About AI-generated content

Your AI generates responses with an on-device model. Like all AI, it can be wrong, incomplete, or outdated. Its responses are not professional advice — please don't rely on it for medical, legal, financial, or other decisions that need a qualified professional. Double-check anything important before acting on it.

Your responsibilities

• Use the app lawfully. Don't use it to harm others or to create or spread illegal content.
• Because your data lives on your device, backups are in your hands. Keep iCloud/computer backups on, or use the in-app export, so a lost or broken phone doesn't mean lost memories.
• When the AI acts on your behalf (reminders, calendar, messages), you are responsible for reviewing what it does at the trust level you granted it.

Intellectual property

The app, its design, and its brand belong to us. Everything you put in — and the memories your AI builds about you — belongs to you.

Disclaimer and limitation of liability

The app is provided "as is", without warranties of any kind. To the maximum extent permitted by law, we are not liable for indirect or consequential damages arising from your use of the app, and our total liability is limited to the amount you paid for it. Nothing in these terms affects rights that consumer law grants you and that cannot be waived.

Termination

You can stop using the app at any time — deleting it removes all local data. We may stop offering the app or its optional online components, but nothing we do can take away the data on your device.

Changes to these terms

If we change these terms, we will update this page and the date above. Material changes will be announced inside the app before they take effect.
